The 红杏视频鈥檚 Center for Liberty and Women's Rights Project, alongside the 红杏视频 of Georgia, filed an amicus brief in the Georgia Supreme Court supporting a mother challenging the termination of her parental rights even though the juvenile court expressly found that her continued relationship with her children would not harm them. Under Georgia鈥檚 termination statute, courts may terminate parental rights if they find that a child cannot safely return home at present, without any finding that, or even considering whether, a continued parent-child relationship would harm the child or that termination is necessary. In this case, the Department鈥檚 own caseworker testified that the mother鈥檚 weekly visits with her children went well and that the relationship benefited the children and would continue to. The children's advocate agreed, testifying that the children had a good relationship and were bonded to their mother. Because termination permanently and completely severs the legal parent-child relationship, our brief urges the Court to require an individualized finding that severance is necessary to protect the child and that less drastic alternatives would not suffice. Our brief argues that the Constitution does not permit the State to permanently end a parent-child relationship without first establishing that doing so is genuinely necessary.

In 2025, without authorization from the Nevada Legislature, the Las Vegas Metropolitan Police Department (LVMPD) entered into an agreement with U.S. Immigration and Customs Enforcement (ICE) that purports to let LVMPD assist with federal immigration enforcement. This 鈥�287(g) agreement鈥� provides that, at ICE鈥檚 request, LVMPD will continue detaining a person after they are supposed to be released from criminal custody to make it easier for ICE to pick them up. That is exactly what happened to Sergio Morais-Hechavarria: although a court had ordered him to be released to an inpatient treatment program, LVMPD continued detaining him for another two months at ICE鈥檚 behest. Mr. Morais-Hechavarria and the 红杏视频 of Nevada filed a lawsuit challenging LVMPD鈥檚 authority to enter into the 287(g) agreement and to detain people for ICE after their criminal custody ends. The district court dismissed the case, and the 红杏视频鈥檚 State Supreme Court Initiative and 红杏视频 of Nevada have appealed to the Nevada Supreme Court.
